Terms of Service
Version of 20 October 2026
These Terms of Service ("Terms") govern your use of Lepka, the AI website builder available at lepka.ai ("Lepka", the "Service"). The Service is provided by MDMA RACINGTEAM OU, Harju maakond, Tallinn, Kesklinna linnaosa, Narva mnt 7-634, 10117, Estonia, registry code 14358188, VAT number EE102031809 ("we", "us"). Our full company details are in the Legal notice.
By creating an account you agree to these Terms. When you buy a subscription, a credit pack or another paid service, these Terms apply to that purchase as well. Please also read our Privacy Policy, which explains how we handle personal data.
In short: you describe a website, Lepka's AI builds it, and you can publish it. AI work is paid in credits. Free credits come with every account; you can buy more as a subscription or as packs. Consumers in the EU have a 14-day right of withdrawal (details), and you can cancel a subscription at any time.
1. Definitions
- Consumer — a natural person who uses the Service for purposes outside their trade, business, craft or profession. Rules marked "for consumers" apply only to consumers. Everything else applies to everyone.
- Business customer — anyone who is not a consumer, for example a company or a freelancer building a site for their business.
- Credits — the unit in which AI work in the Service is paid for (see section 5).
- Your content — everything you or your site's visitors put into the Service: messages, descriptions, files, images, data, and the sites and code created for you.
2. The Service
- Lepka lets you create and edit websites and web applications by describing them in words. The AI writes the code, texts and images, shows a preview, keeps the version history and can publish your site at an address on lepka.cloud or on your own domain.
- Depending on your plan, the Service also includes Lepka Cloud (forms and requests from your site, data storage, user accounts and emails for your site's visitors, file storage), an AI assistant that answers your site's visitors, connections to third-party services, and export of your site's code.
- The Service is based on artificial intelligence. Texts, code and images are generated automatically. AI can make mistakes: it can produce inaccurate facts, prices or contact details, or text and images that resemble existing works. Before publishing, check your site, in particular any information that the law requires for your type of business. Images created by the AI are AI-generated and are not photographs of real places, people or products.
- The current features of each plan are shown on the Pricing page and in the User guide. We provide the Service with reasonable skill and care and keep it in conformity with these Terms during the whole period for which we supply it (section 17).
- We may carry out maintenance and updates. We try to do this without interrupting the Service and to announce planned interruptions in advance.
3. Your account
- To use the Service you need an account. You sign in with a one-time code that we send to your email address. Keep access to your email account secure: anyone who can read your email can sign in to your Lepka account.
- You must be at least 18 years old and able to enter into a contract. If you use the Service on behalf of a company or another organisation, you confirm that you are authorised to accept these Terms on its behalf.
- Each account is for one person or one organisation. Do not create accounts in bulk, share access to buy or use free credits several times, or resell access to the Service.
- We do not provide the Service to persons located or ordinarily resident in Russia, Belarus, Iran, North Korea, Syria, Cuba, in Crimea or Sevastopol, or in the areas of Ukraine's Donetsk, Kherson, Luhansk and Zaporizhzhia regions that are not controlled by the government of Ukraine, nor to persons or organisations subject to EU sanctions. We may block access from these territories.
4. How a contract is concluded
- Free use. The contract for the free use of the Service is concluded when you confirm your email address with the code we send you.
- Paid services. To buy a subscription, a credit pack, a custom domain add-on or a code archive, you choose the product, see its price including VAT and its main terms, and confirm the required checkboxes. Before you click the payment button you can review and correct everything you entered, or close the window. The contract is concluded when you click the button that states that the order is subject to payment (for example "Pay now" or "Start paid subscription") and complete the payment on the payment page of our payment provider Stripe.
- After every purchase we send you an email confirmation with the essential information, these Terms and the information about your right of withdrawal.
- We store the contract text. The current version of these Terms is always on this page; we will send you the version you accepted on request. The Service and these Terms are available in English, German, French, Italian and Spanish; you conclude the contract in the language in which you use the Service, and all language versions have equal force.
5. Credits
- AI work — answering your requests, building and changing sites, creating images, the AI assistant on your site — is paid in credits. How many credits an answer uses depends on how much work it involves. The number of credits used is shown after each answer.
- Credits are used in this order: free credits, then subscription credits, then credits from packs.
- A long answer that is already running can take your balance below zero, but never below minus 2 credits. A negative balance is not a debt that we charge to you: it is simply covered by the next credits you receive.
- Free credits and credits received as a gift or bonus have no monetary value; they cannot be exchanged for money, transferred or refunded.
- Credits are tied to your account and cannot be transferred to another account.
6. Plans and prices
- Free plan. A new account receives 20 free credits. After that, 10 free credits are added 24 hours after you last used credits, up to 20 free credits per calendar month. Free credits do not expire. On the Free plan you can work on up to 3 projects at the same time.
- Subscriptions. Pro costs €9.90 per month and includes 50 credits per month; Business costs €29.90 per month and includes 150 credits per month, plus the features listed on the Pricing page. Subscription credits are renewed at the start of each monthly period and do not carry over to the next period. No free credits are added while you have a subscription.
- Credit packs. A pack is a one-time purchase, not a subscription. Credits from packs do not expire.
| Pack | Price | Price per credit |
|---|---|---|
| 20 credits | €5 | €0.25 |
| 50 credits | €9.90 | €0.20 |
| 150 credits | €29 | €0.19 |
| 500 credits | €89 | €0.18 |
- Custom domain add-on for the Free plan: €5 per month, renewed monthly until cancelled. Custom domains are included in the Pro and Business plans.
- Code archive. In the project settings you can buy an archive of your site's source code to work with it outside the Service. The price depends on the AI work done on the project and is shown before payment (from €5 to €19.80; after new AI work on the project, a later download requires only the difference). This does not affect your right to a free export of all your data when you switch providers (section 16).
- All prices are in euros and include VAT where applicable. The price that applies to you is the one shown before you pay. We may change prices for the future; for existing subscriptions, see section 10.
7. Free trial
- You can try the Pro plan free of charge for 7 days — once per account and per payment card. During the trial you get all Pro features and 20 credits.
- To start the trial you enter a payment card on the Stripe payment page; Stripe checks the card without charging it. If you do not cancel before the trial ends, the Pro subscription starts and €9.90 is charged on the day the trial ends, and then every month until you cancel. We remind you by email the day before the first charge.
- You can cancel at any time during the trial; nothing will be charged. When you cancel, the trial ends immediately: the Pro features and the remaining trial credits are removed, and sites that you changed with trial credits return to their last working version from before the trial. If a site was not published before the trial, it is unpublished. The work done during the trial is kept, and we restore it if you subscribe. The same happens if the trial ends and the first payment fails.
- You can also pay for Pro during the trial: the trial then ends, the paid month starts on the day of payment, and the monthly credits are added to the credits you have left.
8. Payment
- Payments are processed by Stripe. You enter your card details on Stripe's payment page; we never see your full card number. Your bank statement will show "LEPKA".
- Subscriptions are paid in advance for each monthly period and renew automatically every month until you cancel. The first payment is made when you subscribe (or when the free trial ends), and each following payment at the start of the next period. We send a reminder the day before each charge and, after it, a confirmation with the invoice.
- If a renewal payment fails, we tell you by email and the payment is retried over the following days. If it still fails, the subscription ends and your account moves to the Free plan.
9. Cancelling a subscription
- You can cancel a subscription or the custom domain add-on at any time, without giving a reason:
- with one click on the Plans and billing page in your account, or
- on the Cancel subscription page — the link is at the bottom of every page and in every payment email, or
- by writing to info@lepka.ai from the email address of your account.
- The cancellation takes effect at the end of the period you have already paid for: you keep the plan until then, and nothing more is charged. We confirm the cancellation by email straight away, stating the date and time we received it.
- Cancelling does not by itself refund the current period. Refunds are explained in section 11 and on the Withdrawal and refunds page.
10. Changes
- Prices of subscriptions. We will tell you about a price change at least 30 days before it applies to you, by email. The new price applies from the first period that starts after this notice period. If you do not agree, you can cancel before then; periods and packs already paid for are not affected.
- The Service. We continuously develop the Service and may change it for valid reasons — for example to improve it, to adapt to technical developments, for security, or because of legal requirements — at no extra cost to you. If a change negatively affects your access to or use of the Service more than to a minor extent, we will tell you by email at least 30 days in advance, and you may then terminate the contract free of charge within 30 days of the change; we will refund the part of any prepaid amount that relates to the time after termination.
- These Terms. We may update these Terms for valid reasons, for example new features or changes in law. We will notify you of material changes by email at least 30 days before they take effect. If you do not agree, you can terminate the contract before that date; until the end of a paid period, the Terms that applied when you paid continue to apply to it. If you are a business customer, continuing to use the Service after the changes take effect means that you accept them.
11. Right of withdrawal and refunds
- For consumers: you can withdraw from a contract for a paid service within 14 days without giving any reason. The full information about the right of withdrawal, the model withdrawal form and the online withdrawal function are on the Withdrawal and refunds page, which forms part of these Terms.
- Because the Service starts immediately after payment, we only start it during the withdrawal period if you expressly ask us to. If you withdraw, you pay an amount in proportion to what has been provided until you told us about your withdrawal. Your right of withdrawal ends when the service has been fully provided, for example when all credits of a pack have been used. For a code archive, your right of withdrawal ends once the download begins, if you have agreed to this before paying.
- Our refund policy goes beyond the law and applies to everyone: we refund unused credits of packs and of the current subscription month in proportion to their price, a paid code archive that you have not yet downloaded in full, and duplicate or erroneous charges in full. Details are on the Withdrawal and refunds page.
12. Your content and your sites
- Your content remains yours. You give us a non-exclusive, free licence to store, process, reproduce and display your content only as far as needed to provide the Service: for previews and publishing, backups, protecting the Service, and helping you when you contact us. The licence ends when your content is deleted, except for backup copies, which are deleted on their regular schedule.
- Showcase. Published sites may appear in the "Made with Lepka" gallery on our website and in our emails and posts: a screenshot, the site's address and a short description. You can switch this off at any time in the project settings ("Show in gallery"); we then remove the site from the gallery and, on request, from our posts.
- You are responsible for your sites and for what you publish: the texts, prices, images and data, compliance with the laws that apply to your site and business (for example the legal notice, the privacy policy and the cookie consent that your site needs), and the rights to the materials you upload.
- Personal data of your visitors. For the personal data that your site collects (requests and orders from forms, Lepka Cloud data, conversations with the AI assistant, statistics), you are the controller and we are your processor. Our Data Processing Agreement applies to this processing and forms part of these Terms; you accept it by accepting these Terms.
- Connections to other services. If you connect a third-party service to your site (for example a messenger, an email service or a CRM), we send it the data you have configured, on your behalf. You choose these services, are responsible for complying with their terms and with the law, including the rules on international data transfers, and pay for their services. We store your access keys encrypted and use them only for the requests you have set up.
13. AI-generated content and intellectual property
- What Lepka creates for you is yours. As between you and us, the code, texts and images created in the Service for your projects belong to you. To the extent that any rights in them arise for us, we assign them to you, or, where an assignment is not possible, grant you an exclusive, perpetual, worldwide and free licence. You may use, change and publish them as you wish, also outside the Service.
- Content created by AI may not be protected by copyright, and it may by chance resemble existing works, names or trademarks. Check it before you use it, especially logos and names, and do not use the Service to reproduce other people's works or trademarks.
- Templates. You may use a template as the basis for your project, change it and publish the resulting site. You may not distribute the templates as such — for example sell them, give them away or publish them as a collection of templates.
- The Service itself — its software, interface, design, texts and images of our website, templates, AI instructions and settings, databases, the logo and the name "Lepka" — is protected by intellectual property rights of us or our licensors. We grant you a non-exclusive, non-transferable right to use the Service online within its features for the duration of the contract. You may not copy, decompile or otherwise extract its code, except where mandatory law allows it.
14. Rules for using the Service
- You must not use the Service to create, publish or distribute content that is illegal under EU law or the law of the country where the site is directed, in particular:
- child sexual abuse material, or content that sexualises minors;
- terrorist content, incitement to violence or to hatred against people because of their race, religion, origin, sex, sexual orientation or disability, and other content that is a criminal offence;
- phishing and impersonation: sites that pretend to be a bank, an authority, a payment system or another organisation, or that collect card details, passwords, codes or identity documents under false pretences;
- malware, spam, fraud, fake "investment" or "earn on transfers" schemes, money mule recruitment;
- the sale of drugs, weapons, explosives, prescription medicines without authorisation, tobacco and alcohol online where this is prohibited, unlicensed gambling, counterfeit documents or money, protected species, or human trafficking;
- infringements of copyright, trademarks or other rights, or of other people's privacy and personal data;
- intimate images of a person without their consent, and realistic AI-generated images or videos of real people that could deceive viewers.
- You must also not: copy, decompile or otherwise extract the Service's code (except where mandatory law allows it); try to obtain the AI's internal instructions and settings; collect data from the Service by automated means outside its interface; circumvent plan limits or credit accounting; create accounts in bulk or resell access; or disrupt the Service, including by excessive load or attacks.
15. How we enforce these rules (content moderation)
- Automated tools. When you describe a site, automated checks — including AI models — detect requests for content that is clearly prohibited under section 14; the AI then refuses to build it and explains why. After each publication an automated check looks for signs of phishing (for example forms requesting card details or passwords next to the names of banks or authorities) and for scripts from unknown addresses; these checks only alert our team. Decisions to remove content, unpublish a site or restrict an account are taken by a person.
- Reporting illegal content. Anyone can report content on a site created with Lepka that they consider illegal, using the Report a site form. Please give the exact address of the content, explain why it is illegal, give your name and email address (except for reports of child sexual abuse material), and confirm that the information is accurate and complete to the best of your knowledge. We confirm receipt, review the report diligently, objectively and without undue delay, and tell you about our decision and the possibilities of redress.
- Measures. If content or a site breaks the law or these Terms, we may, depending on the severity of the case: ask you to fix it, remove the content, unpublish the site, or suspend or close your account. In clear cases of phishing, malware, fraud or child sexual abuse material we act immediately and without prior notice. In other cases we tell you about the problem and give you time to fix it. Unused paid credits are refunded under section 11.
- Statement of reasons. When we restrict your content or account, we tell you by email what we restricted and for how long, the facts and reasons, whether the decision followed a report or our own check, whether automated means were used, and which law or which provision of these Terms the decision is based on.
- Complaints. You can challenge our decision by replying to that email within six months. A person who was not involved in the original decision reviews your complaint, and we inform you of the result. You can also go to court at any time.
- If we become aware of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of a person has taken place, is taking place or is likely to take place, we inform the competent authorities.
- Points of contact. Authorities of the EU Member States, the European Commission and the European Board for Digital Services can contact us at info@lepka.ai in English or Estonian. Users can contact us at info@lepka.ai in English, German, French, Italian or Spanish; a person answers.
16. Switching and exporting your data
- You can leave the Service at any time — to switch to another provider or to move your sites to your own infrastructure. You do not need to give us notice in advance; to start, write to info@lepka.ai from the email address of your account.
- On request we provide, free of charge, a complete export of your data and digital assets: the source code of your projects (an archive of each project's files), Lepka Cloud data (records in JSON or CSV, user accounts without password hashes), uploaded files, requests and orders from your forms (CSV), and the settings and knowledge base of your AI assistant. Our internal AI instructions and settings, which are our trade secrets, are not part of the export. Information about the formats is in the User guide.
- We start the export without undue delay and complete it within 30 days at the latest; during this time the Service continues to work, and we help you and the provider you choose with the transfer. After that, you can download your data for at least 30 more days. Once the switch is complete, or if you tell us that you want your data deleted instead, the contract ends and we delete your data, except for what we must keep by law (see the Privacy Policy).
- Our servers that store your data are located in the European Union (Germany) and operated under EU law. AI processing is carried out by our provider OpenAI (see Sub-processors). We do not disclose your data to authorities of countries outside the EU unless we are legally required to do so, and we review every such request carefully.
17. Our responsibility for the Service (legal guarantee)
- For consumers: we are liable for any lack of conformity of the Service with these Terms that occurs or becomes apparent during the period in which we supply it to you. If the Service does not conform, tell us at info@lepka.ai. You are entitled to have it brought into conformity free of charge within a reasonable time; if this is not possible or we do not do it, you can claim a proportionate price reduction or terminate the contract. Your statutory rights are not affected by anything in these Terms.
- Because of the nature of AI, individual answers can be incomplete or wrong; you can ask the AI to correct them. When the AI fixes an error that it made itself in the same answer, we do not charge credits for the fix.
18. Liability
- We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under a guarantee we have given, and where liability cannot be limited by law (for example under product liability law).
- In cases of slight negligence we are liable only for breaches of essential contractual obligations — obligations whose fulfilment makes the proper performance of the contract possible in the first place and on which you can regularly rely — and limited to the damage that is typical and foreseeable for this type of contract.
- Apart from this, our liability for slight negligence is excluded. We are not responsible for the services of third parties that you connect yourself, or for the content that you publish.
- If you are a consumer, the limitations in paragraphs 2 and 3 apply only to the extent permitted by the mandatory law of the country where you have your habitual residence.
- For business customers, in cases of slight negligence our total liability is also limited to the amount you paid us in the 12 months before the damaging event.
- You are liable towards us for claims of third parties that arise because your content or your site infringes the law or the rights of others, unless you are not responsible for the infringement.
19. Term and termination
- The contract runs for an indefinite period. You can stop using the Service and ask us to close your account at any time by writing to info@lepka.ai; paid subscriptions end as described in section 9.
- We can terminate the contract with two months' notice by email. In that case we refund the prepaid amounts for the time after the termination and for unused credits from packs.
- Each party can terminate the contract without notice for good cause — for us in particular in the cases described in section 15.
- After the contract ends, your sites are taken offline. We keep your data for 30 more days so that you can export it (section 16), and then delete it, except for what we must keep by law.
20. Applicable law and disputes
- These Terms are governed by the law of Estonia. For consumers, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you have your habitual residence.
- For consumers: you can bring proceedings against us in the courts of the country where you live or in Estonia; we can bring proceedings against you only in the courts of the country where you live. For business customers: the courts of Estonia (Harju County Court, Tallinn) have exclusive jurisdiction.
- Please contact us first at info@lepka.ai; we reply to complaints within 14 days. Consumers can also refer a dispute to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon, Endla 10A, 10122 Tallinn, ttja.ee/tarbijavaidluste-komisjon); its procedure is in Estonian. For help with a cross-border dispute, consumers can contact the European Consumer Centre in their country (ECC-Net).
21. Final provisions
- We send legally relevant messages to the email address of your account; you can send yours to info@lepka.ai.
- We may transfer the contract to another company that continues to provide the Service, if your rights are not reduced as a result. We will tell you in advance, and if you are a consumer you may terminate the contract before the transfer takes effect.
- If any provision of these Terms is invalid, the rest remains valid.
